Terms of Service

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) and able to form a binding contract under applicable law to use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current information and keep it updated.
• You must notify us immediately of any unauthorized use of your account.

3. Subscriptions, Billing & Free Trials

• Free plan: limited to a capped number of hooks and vehicles. You may use the free plan indefinitely subject to these Terms.
• Free trial: new accounts automatically receive a 30-day Pro trial. No payment method is required. The trial ends automatically and the account reverts to the free plan unless you subscribe. Only one trial per user.
• Paid subscriptions are processed by Stripe and renew automatically at the cadence you select (monthly or yearly) until canceled.
• Cancellation: you may cancel anytime from the Billing portal. Cancellation takes effect at the end of the current billing period; the Service remains available until then. We do not provide pro-rated refunds for unused time except where required by law.
• Price changes:we will provide at least 30 days’ notice of any material price increase. Continued use after a price change constitutes acceptance.
• Taxes: prices are exclusive of applicable taxes, which may be collected by Stripe based on your billing location.

4. Acceptable Use

You agree not to:

• Violate any applicable law or third-party right.
• Upload malicious code, attempt to breach our security, or disrupt the Service.
• Use the Service to send spam, harass, or harm others.
• Scrape, crawl, or reverse-engineer the Service except as permitted by law.
• Resell, sublicense, or commercially exploit the Service without our written consent.
• Impersonate any person or misrepresent your affiliation with any entity.

5. Your Content

You retain all rights to the data and content you submit to the Service (“Your Content”). You grant us a limited, non-exclusive, royalty-free license to host, store, transmit, and display Your Content solely to operate and provide the Service to you. We do not claim ownership of Your Content and we do not use it to train AI models.

You are responsible for Your Content and represent that you have the rights necessary to submit it.

6. Service Availability

We strive for high availability but the Service is provided on an “as is” and “as available” basis without uptime guarantees. We may modify, suspend, or discontinue the Service (or features within it) at any time, with reasonable notice where practical.

7. Third-Party Services

The Service integrates with third-party providers including Google, Meta (Facebook), Apple, and Stripe. Your use of those providers is governed by their own terms and privacy policies. We are not responsible for their acts or omissions.

8. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Georgia Motorsports Media, LLC and its licensors and is protected by intellectual property laws. Except for the limited license granted to use the Service, no rights are transferred to you.

9. Termination

You may stop using the Service at any time and delete your account from Settings. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or for prolonged inactivity. Upon termination, your right to use the Service ends immediately; sections that by their nature should survive termination (e.g., IP, disclaimers, limitations of liability, indemnity, dispute resolution) will survive.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GMM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless GMM and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) Your Content, or (c) your violation of these Terms or any third-party right.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. The exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Georgia, and you consent to personal jurisdiction there.

Informal resolution: before filing any claim, you agree to first contact us at keith@georgiamotorsports.media and attempt to resolve the dispute informally for at least 30 days.

14. Changes to These Terms

We may modify these Terms from time to time. The effective date will be updated at the top, and for material changes we will provide reasonable notice (e.g., in-app banner or email). Continued use after the effective date constitutes acceptance.
